Lahore High Court issues landmark fair trial ruling in rent cases

The Lahore High Court has delivered a significant judgment on ex-parte proceedings in rent disputes, setting aside the Rent Tribunal’s ex-parte order against a petitioner and laying down important legal principles to safeguard the right to a fair hearing in tenancy cases.

Justice Justice Muzammil Akhtar Shabbir issued a detailed 14-page judgment, declaring that “delay in justice amounts to denial of justice, while undue haste in dispensing justice is equivalent to burying justice.” The ruling has been declared a judicial precedent for future rent litigation.

The High Court held that under the relevant tenancy laws, a Rent Tribunal is legally required to allow a period of 10 days before initiating ex-parte proceedings against the opposite party. During this period, the absent party retains the legal right to appear before the tribunal and seek restoration of its right to contest the proceedings.

The court further ruled that if ex-parte proceedings are initiated in violation of the prescribed legal procedure, such proceedings become unlawful, and any judgment passed on their basis is also liable to be declared void.

Justice Shabbir observed that Rent Tribunals must ensure proper service of notices on the opposite party before proceeding ex-parte. The judgment noted that the Rent Tribunal in the present case had failed to follow the statutory procedure governing ex-parte proceedings under the rent law.

The High Court also held that the tribunal’s decision dismissing the petitioner’s application for restoration of proceedings was contrary to law.

Consequently, the court set aside the judgments of both the Rent Tribunal and the appellate court. It ordered that the matter be treated as pending before the trial court and directed the trial court to decide the case strictly on its merits within four months.

The High Court further instructed that no applications seeking unnecessary adjournments by either party should be entertained, emphasising the need for the expeditious disposal of the tenancy dispute while ensuring compliance with due process and the principles of natural justice.

Pakistani mountaineers successfully cross historic phargam An Pass

A team of Pakistani mountaineers has successfully crossed the historic Phargam An Pass in the Hindu Kush mountain range for the first time in 27 years, marking a significant milestone in the country’s mountaineering history. Standing at an altitude of 5,100 meters (16,732 feet), the challenging pass was successfully summited by the expedition team after navigating some of the region’s most demanding terrain. The expedition also made history by becoming the first to include female mountaineers who successfully reached the summit of Phargam An Pass. Their achievement represents a major step forward for women’s participation in Pakistan’s adventure tourism and mountaineering community, highlighting the growing presence of female athletes in high-altitude expeditions. The expedition was organized with the support of the Khyber Pakhtunkhwa Culture and Tourism Authority and took place in Upper Chitral, an area renowned for its spectacular mountains, glaciers, and remote landscapes. The mission aimed not only to revive a historic route but also to promote adventure tourism in the region while showcasing Pakistan’s rich natural beauty. During the expedition, the team made another remarkable discovery by locating the memorial of Austrian mountaineer George Kronberger, who tragically lost his life in the area in 1975. Finding the memorial added historical significance to the expedition, connecting the modern-day climbers with an important chapter in the history of mountaineering in the Hindu Kush. The journey to Phargam An Pass was far from easy. Team members crossed vast glaciers, climbed steep snow-covered slopes, traversed rocky mountain trails, and carefully navigated areas threatened by avalanches. Despite these hazardous conditions, the climbers successfully completed the expedition through careful planning, teamwork, and determination. Expedition guide Zamrud Khan noted that climate change has significantly altered the route to Phargam An Pass over the years. According to him, melting glaciers, changing snow conditions, and shifting mountain landscapes have made the route considerably different and more challenging compared to previous decades. His observations underline the visible impact of global climate change on Pakistan’s high-altitude regions and the increasing challenges faced by mountaineers. A particularly inspiring aspect of the expedition was the participation of three sisters from Chitral—Mahrosh Akhtar, Ismeel Roz, and Madhu Shala Akhtar—who became part of this historic journey and set a new example for aspiring female adventurers across Pakistan. Their achievement demonstrates that women are increasingly breaking barriers in fields traditionally dominated by men and encouraging future generations to pursue outdoor sports and exploration. The expedition team included Kamran Khan, Mahrosh Akhtar, Samar Khan, Nauman Khan, Noorul Rahman, Zohaib Khan, Umar Khattab Sherani, Sahnia Babar, Amina Shabbir, and Madiha Syed. Their successful completion of this demanding mission not only revived a historic mountain pass after nearly three decades but also highlighted Pakistan’s immense potential for adventure tourism. The expedition serves as a testament to the resilience, courage, and teamwork of Pakistani mountaineers while drawing attention to the need for preserving the fragile mountain environment in the face of climate change.

Five killed in tragic Car crash on Lahore’s cana…

LAHORE: Five people were killed and another was injured in a tragic road accident on Lahore’s Canal Road after a speeding car reportedly went out of control and struck two pedestrians before crashing into a utility pole and a tree. According to Rescue 1122, the accident occurred on Canal Road near Harbanspura in Lahore. The incident claimed the lives of three young people travelling in the car as well as two pedestrians who were walking along the roadside. According to eyewitnesses, the driver of the car was allegedly performing drifting on the road when he lost control of the vehicle. The car reportedly mounted the footpath alongside the canal and struck two young pedestrians. It then continued moving before crashing into an electricity pole and a tree. The impact of the collision was severe, resulting in multiple fatalities. Three occupants of the vehicle died at the scene, while two pedestrians also lost their lives as a result of being hit by the speeding car. An 11-year-old boy who was travelling in the car was injured in the accident. Rescue teams reached the site after receiving information about the crash and began rescue and emergency operations. The injured child was shifted to a nearby hospital for medical treatment. According to information available after the incident, the four people travelling in the car were cousins. The victims were reportedly young, with the ages of those who died ranging between 15 and 18 years. A report regarding the circumstances before the accident stated that the four boys had allegedly left their home around 6am while their family members were still asleep. They reportedly took the car and went out, after which the fatal accident occurred on Canal Road. The incident has raised concerns about dangerous driving and the risks associated with speeding and performing stunts on public roads. Drifting, particularly at high speed and on busy roads, can result in a driver losing control of a vehicle within seconds. The consequences can be devastating not only for the occupants of the vehicle but also for pedestrians and other road users. Canal Road is an important route in Lahore and carries significant traffic throughout the day. Although the accident occurred early in the morning, the presence of pedestrians near the roadside made the situation particularly dangerous. The deaths of the young people have caused grief among their families and relatives. The fact that the victims were reportedly teenagers has added to the tragedy, while the two pedestrians who were also killed became unintended victims of the alleged reckless driving. Authorities are expected to investigate the circumstances of the crash, including the speed of the vehicle and the eyewitness claims that the driver had been performing drifting before losing control. Investigators may also examine the vehicle and the accident site to determine the exact sequence of events. The accident once again highlights the importance of responsible driving, particularly among young drivers. Speeding, reckless manoeuvres and driving without adequate experience can have fatal consequences. The incident serves as a tragic reminder that public roads are shared spaces and that reckless behaviour behind the wheel can put the lives of innocent pedestrians and passengers at serious risk. Families and road safety authorities have repeatedly urged young people to avoid dangerous driving practices and follow traffic regulations. Further details regarding the investigation and the condition of the injured 11-year-old are expected as authorities continue to assess the incident.
