Australian court rejects Indian appeal in Basmati …

 

An Australian court has dismissed an appeal filed by the Agricultural and Processed Food Products Export Development Authority (APEDA) in the Basmati word mark case, marking a significant legal development for Pakistan’s rice exporters.

According to the Ministry of Commerce, the Australian court’s decision has reaffirmed Pakistan’s principled position that the term “Basmati” cannot be treated as the exclusive property of India. The ruling is being viewed by Pakistani authorities as an important legal success in protecting the rights of the country’s Basmati rice producers and exporters.

The Australian court has also ordered the Indian institution APEDA to pay the legal costs associated with the proceedings. The decision follows a legal dispute over the use and registration of the word “Basmati” in Australia.

APEDA had applied to register the word “Basmati” as a certification trademark. The application was challenged, leading to legal proceedings concerning whether the term could be claimed exclusively for Indian rice products.

Pakistan has consistently maintained that Basmati rice is also produced in Pakistan and that Pakistani exporters should have equal rights to use the name. The Ministry of Commerce said Australian authorities had already acknowledged that Basmati rice is produced in Pakistan, strengthening Islamabad’s position in the dispute.

The latest court decision has therefore been welcomed by Pakistani officials as confirmation of the country’s longstanding stance on the geographical and commercial identity of Basmati rice.

The Ministry of Commerce stated that the ruling represents an important legal victory for Pakistan because it supports the principle that Pakistani exporters should not be deprived of the right to use the term Basmati for rice produced in the country.

Federal Minister for Commerce Jam Kamal congratulated the Ministry of Commerce team on what he described as Pakistan’s legal success in the case. He appreciated the efforts of the officials and legal representatives involved in defending Pakistan’s position before the Australian authorities.

The dispute is significant because Basmati rice is an important agricultural and export commodity for both Pakistan and India. The term has considerable commercial value in international markets because consumers associate Basmati with a distinctive variety of aromatic long-grain rice.

Pakistan is among the countries known for producing and exporting Basmati rice, particularly from areas in Punjab. The country has sought greater recognition of its rights over the Basmati name in international markets, arguing that the rice is a shared agricultural heritage of the region and is produced on both sides of the border.

APEDA’s attempt to register “Basmati” as a certification trademark had raised concerns in Pakistan because exclusive registration could potentially affect Pakistani exporters’ ability to market their products using the internationally recognized name.

The Australian court’s rejection of APEDA’s appeal is consequently being seen by Pakistan as an important development in safeguarding its exporters’ commercial interests. The order requiring APEDA to pay legal costs also adds to the significance of the decision for Pakistan.

The Ministry of Commerce has emphasized that the ruling strengthens Pakistan’s position in international legal and commercial forums. Pakistani authorities are expected to continue protecting the interests of local rice growers and exporters and ensuring that they retain the right to market their Basmati rice under its recognized name.

The decision could also contribute to broader efforts to strengthen Pakistan’s agricultural exports and promote its Basmati rice in international markets.

    ISLAMABAD: The Pakistan Information Commission (PIC) has declared the Pakistan Bar Council (PBC) a public body under the Right of Access to Information Act, 2017, and directed it to provide within 15 days information sought regarding lawyers’ degrees, licence cancellations, government grants and governing body proceedings. The order was issued in appeal titled Saddia Mazhar vs Pakistan Bar Council, by Chief Information Commissioner Shoaib Ahmad Siddiqui and Information Commissioner Ijaz Hassan Awan. The applicant had sought eight categories of information, including province-wise numbers of PBC members or licence holders; those who had submitted attested degrees; lawyers whose licences were cancelled for failing to submit attested educational documents; and those whose licences were cancelled over fake degrees. She also sought copies of circulars and notifications concerning degree attestation, details of federal and provincial government grants received since 2020, including amounts and dates, and a copy of the latest minutes of the PBC Governing Body meeting. In its reply to the Commission, that the PBC maintained that it was an autonomous statutory body generating its own funds and did not fall within the definition of a public body. Its representatives argued that the government exercised neither financial nor administrative control over it, while acknowledging that the Attorney General for Pakistan is its ex officio member. The Commission rejected the PBC’s position, holding that it is a statutory organisation established under the Legal Practitioners and Bar Councils Act, 1973, and performs important public functions relating to legal education, recognition of law degrees and regulation of legal practitioners. It also observed that Bar Councils receive public funds or government grants and their offices are located in public buildings. The PIC ruled that the PBC falls within the definition of a public body under Section 2(ix)(g) and (h) of the Right of Access to Information Act, 2017. It further held that none of the eight information requests attracted an exemption under the law. The Secretary, Pakistan Bar Council, was consequently directed to provide the requested information within 15 days of receiving the order. The case was adjourned until September 2, 2026.

    Japanese influencer dies by suicide amid online trolling

    A Japanese influencer living in South Korea reportedly died by suicide during a TikTok livestream, following intense online trolling and criticism. According to international media reports, Mina-chan was found dead at her residence in Seoul on August 5 after viewers alerted police during a livestream. Yongsan Police responded to the report and found her body at the scene. Mina-chan was a popular TikTok creator and a fan of K-pop group ENHYPEN. She had around 80,000 followers on the platform. Her younger sister later confirmed her death through a post on Instagram. Reports said Mina-chan had faced criticism on social media after an incident at an ENHYPEN concert in the United States last month. During the event, she reportedly asked the group’s member Sunoo to pass flowers she had brought to another Japanese member, Ni-ki. Following the incident, some fans accused her of crossing boundaries with the group members. She subsequently became the target of criticism and online trolling. On July 31, Mina-chan posted a lengthy apology on X. She said she believed she had taken advantage of Sunoo’s kindness and expressed regret over her actions. She also said that after attending several fan-sign events, she had mistakenly developed the impression that she was particularly close to the members of the group.     NEW DELHI: Indian Prime Minister Narendra Modi has announced a major education and skills initiative aimed at addressing growing concerns among young people over employment, competitive exams and the rising cost of education. Speaking at India’s Independence Day ceremony at the Red Fort, Modi said the government would offer free online coaching for a range of competitive examinations. He said the programme would help reduce the financial pressure on families whose children spend years preparing for highly competitive entrance and recruitment tests. The announcement follows nationwide youth protests sparked by allegations of examination paper leaks and recruitment irregularities. The demonstrations intensified pressure on the government and contributed to the resignation of Education Minister Dharmendra Pradhan last month.
