The Supreme Court of Pakistan has ruled that the widow of a deceased retired employee is the lawful recipient of the employee’s pension and post-retirement benefits, clarifying that siblings cannot claim such benefits solely on the basis of being legal heirs.

The ruling was issued in a detailed four-page written judgment authored by Chief Justice Yahya Afridi. The decision provides important legal clarification on the distribution of pension and retirement benefits after the death of a retired government employee.

According to the judgment, pension is not treated as inherited property that can automatically be divided among all legal heirs. Instead, the court held that pension payments are governed by the relevant laws, service rules and institutional regulations.

The Supreme Court stated that the widow of a deceased retired employee has the primary legal right to receive the pension and related benefits. It further observed that if a person has been legally nominated under the applicable rules, that nominee would also be entitled to receive the benefits.

The court made it clear that brothers and sisters cannot claim a deceased employee’s pension merely because they are legal heirs under inheritance laws. It explained that pension rights arise from specific statutory provisions and are separate from the general rules governing inheritance.

The judgment emphasised that all pension payments must be made strictly in accordance with the applicable laws and the regulations of the concerned institution. Authorities responsible for disbursing pensions must follow these legal provisions while determining the rightful beneficiary.

The case reached the Supreme Court after the siblings of a deceased employee of the Peshawar Electric Supply Company (PESCO) challenged an earlier court ruling and sought a succession certificate to claim pension-related benefits.

After reviewing the case, the apex court dismissed the appeal and upheld the decision of the Peshawar High Court, which had ruled that the siblings were not entitled to receive the deceased employee’s pension.

The Supreme Court observed that pension is a statutory benefit and cannot be distributed under ordinary inheritance principles unless specifically permitted by the relevant legal framework.

    Islamabad: The Senate Sub Committee on National Heritage and Culture has raised serious concerns over the condition of Quaid e Azam’s Mausoleum, questioning the slow maintenance work, damaged boundary walls, cleanliness issues and security arrangements at one of Pakistan’s most important national monuments. The issue came under discussion during a meeting of the Sub Committee held at Parliament Lodges, Islamabad, under the chairmanship of Senator Syed Waqar Mehdi. The meeting was held to review progress on earlier recommendations regarding administrative, renovation and development matters of Quaid e Azam’s Mausoleum and its surrounding areas. Senator Syed Waqar Mehdi expressed concern over wall chalking and the poor condition of the boundary wall around Mazar e Quaid. He directed the concerned authorities to start urgent renovation work. Federal Secretary for National Heritage and Culture Mr. Asad Rehman Gillani informed the Committee that the boundary wall had not received proper maintenance since 2017 and assured that the issue would be addressed soon. Senator Bushra Anjum Butt also expressed dissatisfaction over the lack of attention given to the national heritage site and questioned why such an important symbol of Pakistan was not receiving the required priority from relevant authorities. The Committee reviewed several operational issues including security, electricity and water supply. Mr. Asad Rehman Gillani informed the Committee that some problems had already been resolved, while remaining matters would be completed at the earliest. The meeting was attended by Senator Bushra Anjum Butt and Senator Sarmad Ali through Zoom. Representatives of the Quaid e Azam Mazar Management Board also participated. Officials from K Electric, Karachi Metropolitan Corporation, Sindh Solid Waste Management Board, Karachi administration and police authorities also attended the meeting. The Committee directed authorities to improve security arrangements at the Mausoleum by installing CCTV cameras across the premises and ensuring deployment of sufficient police personnel. Senator Syed Waqar Mehdi also directed that a complete security plan should be prepared before reopening the Mausoleum for the general public, including deployment of a Special Security Unit. During the discussion, the Committee also raised concerns regarding individuals involved in drug abuse found inside the Mausoleum premises. SSP East Karachi informed the Committee that such individuals are usually granted bail within two to three days after legal proceedings and are later referred to the Edhi Foundation for rehabilitation. Senator Syed Waqar Mehdi also highlighted financial concerns regarding the maintenance of Mazar e Quaid. He observed that the Government of Sindh currently carries the financial responsibility for maintaining the Mausoleum and suggested that other provinces, Gilgit Baltistan and Azad Jammu and Kashmir should also contribute annually towards its maintenance and operational expenses. The Committee expressed dissatisfaction over incomplete sanitation work around the Mausoleum. Officials informed that general waste had been removed, but construction debris was still present in surrounding areas. Senator Syed Waqar Mehdi directed immediate removal of all remaining waste and debris. The Committee also took notice of coordination issues among government departments and expressed displeasure over the absence of the Director General Karachi Development Authority from the meeting. To improve coordination, Senator Syed Waqar Mehdi directed all concerned departments to create a dedicated communication group where updates regarding Mazar e Quaid improvement work could be shared quickly. He also instructed officials to provide before and after pictures of development and maintenance activities. The Committee further directed that one Member of the National Assembly and one Senator from Karachi should be included in the Quaid e Azam Mazar Management Board. It also recommended including the President of Karachi Chamber of Commerce and Industry in the Board to improve public and business sector involvement. The Sub Committee will hold another follow up meeting after August 14 to review the progress of all departments and assess whether the required improvements have been completed.

    Islamabad: Serious questions have been raised over the construction quality and progress of the Rs 7.1 billion New Parliament Lodges Project after the Senate House Committee found major differences between official claims and the actual condition observed during inspection. The committee was informed that although significant progress was claimed, the inspection team found that only around 20 percent of the 104 new Parliament Lodges were functionally complete. Senators raised concerns over construction standards, design changes and the quality of facilities being developed with public funds. The Senate House Committee, chaired by Senator Syedal Khan, Deputy Chairman Senate and Chairman Senate House Committee, expressed concern over the findings and decided to move towards a detailed forensic audit to examine the quality of construction work, repairs and maintenance activities. During the meeting, Senator Kamil Ali Agha informed the committee that several issues were identified during the inspection of the new lodges. These included changes from the originally approved central air conditioning system to individual air conditioning units, poor ventilation arrangements, problems in ceiling fan installation due to design limitations and unsuitable placement of storage areas near lodge entrances. Senators questioned whether the project was being completed according to the originally approved design and whether the quality of construction matched the cost involved. Officials from the Capital Development Authority informed the committee that the grey structure of the lodges had been completed and finishing work was currently underway. They stated that imported lifts were yet to be installed and furniture for the lodges had already been ordered. The CDA representative further informed the committee that an architect had been hired to prepare a model lodge design for the renovation of existing Parliament Lodges. The renovation plan would include improvements in electrical systems and other related facilities. The committee also discussed complaints regarding maintenance and repair work in existing Parliament Lodges. Senator Jan Muhammad highlighted that only limited funds had been allocated for the repair of his allotted lodge despite repeated requests over the past three years. CDA officials informed the committee that funds for the first quarter had been released and the tendering process would begin soon. They expected repair work to start in the first week of September 2026. The Ministry of Planning, Development and Special Initiatives informed the committee that the total cost of the 104 New Parliament Lodges Project stands at Rs 7.1 billion. Out of this amount, Rs 3.5 billion has already been spent, while Rs 1.1 billion has been allocated during the current financial year. The committee also discussed concerns related to transparency and accountability. CDA officials informed members that the Auditor General of Pakistan had already started an external forensic audit of repair and maintenance works, and the final report was awaited. However, the committee decided that a broader independent forensic audit should also be conducted for both the existing Parliament Lodges and the construction of the new 104 lodges. Senator Syedal Khan proposed that a professional consultancy firm led by Syed Shabbar Zaidi should conduct the audit. Senator Kamil Ali Agha supported the proposal, describing the firm as highly professional. The committee unanimously recommended engaging the firm to ensure transparency, accountability and better quality control. The committee stressed that Parliament projects must meet the highest standards because they are funded through public money. Members said timely completion, quality construction and proper use of funds would remain under strict parliamentary monitoring.
