Supreme Court bars fresh claims after final contra…

ISLAMABAD: The Supreme Court of Pakistan has ruled that contractors cannot pursue additional financial claims or seek arbitration after voluntarily accepting a final settlement, reinforcing the binding nature of contractual agreements.

A three-member bench headed by Chief Justice Yahya Afridi, alongside Justice Irfan Saadat Khan and Justice Aqeel Ahmed Abbasi, dismissed a petition seeking permission to appeal against an earlier ruling of the Peshawar High Court. Justice Irfan Saadat Khan authored the judgment.

The dispute originated from a construction contract awarded in December 1993 for the Hayatabad Medical Complex in Peshawar. During the project, the contractor sought additional payments, citing delays and funding shortages.

According to the judgment, the company later accepted Rs88.555 million as final payment and signed a No Demand Certificate, formally giving up its right to pursue further financial claims under the contract.

Despite the settlement, the contractor subsequently approached the courts seeking arbitration over additional demands. The trial court and the Peshawar High Court rejected the request, and the Supreme Court has now upheld those decisions.

The apex court clarified that once a party willingly accepts final payment and signs a No Demand Certificate, it cannot reopen financial claims or invoke arbitration unless it can establish that the settlement was secured through fraud, coercion or undue influence.

The court stressed that voluntarily concluded agreements must remain enforceable, particularly in public-sector development projects where contractual certainty is essential. It warned that allowing settled disputes to be reopened without evidence of wrongdoing could weaken confidence in contracts and create uncertainty in commercial dealings.

The session brought together policy leaders and prominent figures to discuss four books authored by Republic Policy: Fixing the Executive, Fixing the Legislature, Fixing the Judiciary, and The Bureaucratic Coup. A New Federal Democratic Governance Model According to Republic Policy, the proposed model seeks to establish a governance framework aligned with Pakistan’s federal constitutional structure, democratic representation, parliamentary supremacy and principles of effective public administration. The think tank said the initiative goes beyond criticism of the existing governance system and seeks to offer a practical alternative based on constitutional supremacy, democratic accountability, federalism and stronger parliamentary institutions. The model also addresses longstanding debates surrounding decentralisation, bureaucratic influence and the balance of power among the executive, legislature and judiciary. Reform Agenda Draws Appreciation Sources attending the event said the governance model and the four books received appreciation from participants, including former Prime Minister Anwar-ul-Haq Kakar, Gohar Ejaz and Sir Ahmed Nawaz Sukhera. A representative of Republic Policy said fundamental reforms in Pakistan’s governance system would need to become a central part of the national debate on the country’s future. “The encouragement we received is immensely encouraging for us,” the representative said, stressing the importance of continuing discussions on structural governance reforms. Focus on Constitutional Governance The Economic Policy and Business Development Think Tank was established to promote policy dialogue on economic and governance issues in Pakistan. The presentation of the Republic Policy Governance Model adds a new dimension to discussions on institutional reform, decentralisation, bureaucratic overreach and parliamentary empowerment. Republic Policy maintains that strengthening democratic institutions and ensuring governance within the framework of the Constitution are essential for improving the effectiveness and accountability of the Pakistani state.

    PSX rallies over 400 points in early trading as investor sentiment improves

    KARACHI: Buying activity returned to the Pakistan Stock Exchange (PSX) on Monday, with the benchmark KSE-100 Index gaining more than 400 points during the opening phase of trading as investors showed renewed interest in major sectors. At around 9:50am, the benchmark index was trading at 181,880.56 points, recording an increase of 450.54 points, or 0.25%, compared with the previous close. The positive momentum was supported by buying across several key sectors, including automobile assemblers, cement companies, commercial banks, oil and gas exploration firms, oil marketing companies (OMCs) and refineries. Several heavyweight stocks also contributed to the upward movement. HUBCO, ARL, OGDC, POL, PPL, PSO, HBL, MCB, MEBL and NBP were among the prominent index constituents trading in positive territory during the early session. The latest gains came after the stock market delivered a strong performance last week, when easing geopolitical concerns helped improve investor confidence. Developments surrounding diplomatic efforts between Iran and Oman regarding shipping activity through the strategically important Strait of Hormuz, coupled with expectations of a possible wider understanding between the United States and Iran, provided some relief to financial markets. Conversely, a softer reading could strengthen expectations of a more accommodative monetary policy. Market pricing currently indicates that expectations for a September rate move have weakened. The probability of such a move has fallen to roughly 44%, compared with about 67% a week earlier. The decline in expectations for higher interest rates supported US Treasury bonds on Friday and helped major Wall Street indices finish at record levels. Asian equities follow Wall Street Asian markets broadly followed the positive lead from the United States on Monday. Japan’s Nikkei 225 advanced around 0.6%, while South Korea’s benchmark index gained approximately 0.5%. Meanwhile, MSCI’s broadest index of Asia-Pacific shares excluding Japan rose about 0.3%. For Pakistan’s equity market, the combination of stronger global sentiment, improved geopolitical expectations and renewed buying in heavyweight stocks provided support at the start of Monday’s session.

    Trump’s former lawyer Todd Blanche confirmed as US attorney general

    Todd Blanche, a former personal attorney to US President Donald Trump, has been confirmed as the country’s attorney general after a closely contested Senate vote. Blanche secured confirmation by 50 votes to 49, with Republican Senators Susan Collins and Lisa Murkowski joining Democrats in opposing his nomination. Senator Bill Cassidy provided the crucial Republican vote in Blanche’s favour after saying he believed Blanche was the strongest candidate Trump was likely to nominate. The vote ended a prolonged dispute between the Trump administration and Senate Republicans over Blanche’s appointment. He had been serving as acting attorney general since April, after Pam Bondi was removed from the position. All Senate Democrats voted against Blanche’s confirmation. Several Republican lawmakers had questioned Blanche’s record and raised concerns about his involvement in a number of controversial matters. Among them was his handling of documents related to convicted sex offender Jeffrey Epstein and his role in developing Trump’s proposed $1.8 billion “anti-weaponization” fund. The proposed fund was intended to compensate people who claimed they had been politically targeted or persecuted by the government. However, critics, including Murkowski, warned that the scheme could potentially benefit people prosecuted for their involvement in the January 6, 2021 attack on the US Capitol. During his confirmation process, Blanche promised to abandon the proposed fund following opposition from Republican senators. Questions remain over whether that commitment would prevent the administration from introducing a similar programme under a different structure in the future. Murkowski said she opposed Blanche because she lacked confidence that he would be willing to challenge what she described as the administration’s worst impulses. She also expressed concern about the increasing politicisation of the Justice Department. Collins raised separate concerns over Blanche’s involvement in Trump’s $10 billion lawsuit against the Internal Revenue Service. Despite those reservations, she ultimately did not support his confirmation. Cassidy, meanwhile, said he trusted Blanche to provide Trump with independent and candid legal advice. He acknowledged that the president ultimately determines the direction of the Justice Department but argued that Senate confirmation would give Blanche greater authority to advise the administration and push back when necessary. Cassidy also said he did not want political disagreements to prevent the Justice Department from carrying out its responsibilities, particularly in combating violent crime. Blanche’s confirmation marks a significant development for the Trump administration, given his previous role as Trump’s personal lawyer. He was serving as deputy attorney general when he assumed the department’s temporary leadership in April.
