The Federal Constitutional Court has issued an important ruling in favour of corporate taxpayers.

The court has declared the adjustment of tax credits against super tax legally valid. It has also overturned an earlier decision of the Islamabad High Court.

Justice Amir Farooq authored the six-page detailed judgment. The court accepted the appeals filed by a private mobile phone company.

The case relates to the adjustment of tax credits against super tax. The company had challenged a demand raised by the Federal Board of Revenue (FBR).

The FBR had issued a notice to the private company. The notice required the company to pay super tax.

The company approached the Islamabad High Court after receiving the notice. It argued that its available tax credit should be allowed to adjust against the super tax liability.

The Islamabad High Court rejected the company’s petition. The company then challenged that decision before the Federal Constitutional Court.

The Federal Constitutional Court has now accepted the company’s appeals. It has declared that tax credits available to a taxpayer can be adjusted against super tax.

The court referred to the relevant provisions of the tax law. It observed that the tax credit available under Section 168 is a separate and legally recognised right.

According to the judgment, a taxpayer should not be prevented from using this credit for adjustment. The court said forcing a taxpayer to seek only a refund would not be consistent with the intention of the law.

The judgment also addressed the interpretation of financial and tax laws. The court observed that such laws should be interpreted in a manner that facilitates taxpayers.

The court emphasised that taxpayers should be able to exercise rights provided to them under the law. A legal right to a tax credit cannot be unnecessarily restricted through an interpretation that creates additional difficulties for taxpayers.

The court also issued directions to the FBR.

The FBR has been directed to examine the taxpayer’s claim for adjustment. The department must consider the claim in response to the tax notice.

The FBR will now have to decide the matter according to the applicable law and the court’s ruling.

The judgment provides an important clarification for corporate taxpayers. It establishes that an eligible tax credit can be considered for adjustment against a super tax liability.

The ruling may also have wider implications for companies facing similar tax demands. Businesses with legally available tax credits may now rely on the court’s interpretation when seeking adjustments against their tax liabilities.

By setting aside the Islamabad High Court’s decision, the Federal Constitutional Court has clarified the legal position on the issue.

The case also highlights the continuing dispute between taxpayers and the FBR over the interpretation and application of tax laws.

    Karachi traffic police issue comprehensive traffic…

      The Karachi Traffic Police have announced a comprehensive traffic management plan for the city’s central Chehlum procession, informing residents that M.A. Jinnah Road will remain closed to traffic throughout the event. The special arrangements have been introduced to ensure the smooth movement of the religious procession while minimizing inconvenience for commuters. Citizens have been advised to plan their travel accordingly and use the designated alternative routes to avoid delays. According to the traffic police, all traffic traveling from Saddar toward Tower will be diverted through Preedy Street and I.I. Chundrigar Road. In addition, several key intersections and commercial areas, including Lighthouse, Empress Market, Regal Chowk, and Tibet Centre, will have temporary traffic diversions in place. These measures are intended to keep vehicles away from the procession route and maintain public safety during the event. Motorists approaching from Shahrah-e-Quaideen will be redirected toward Kashmir Road and Peoples Chowrangi. Vehicles arriving from Korangi, Landhi, and the National Highway will be diverted through Rashid Minhas Road before proceeding to the Super Highway. Traffic officials have urged drivers from these areas to follow diversion signs and cooperate with law enforcement personnel deployed along the routes. Commuters traveling from Nazimabad will be able to reach their destinations through Lasbela, Garden, and Nishtar Road. Similarly, traffic coming from Liaquatabad will be diverted at Lasbela Chowk toward Nazimabad No. 10. These alternate routes have been identified to reduce congestion and facilitate the movement of vehicles while the main procession route remains inaccessible. The traffic plan also outlines arrangements for vehicles coming from Hassan Square. Such traffic will be directed through Shahrah-e-Quaideen, Society Light Signal, and Teen Hatti before reaching Lasbela Chowk. Meanwhile, motorists traveling from Shahrah-e-Faisal will be guided through Society Light Signal and Sher Shah Suri Road to continue their journeys. Drivers using Jamshed Road and intending to travel toward Gurumandir have been advised to use Bahadur Yar Jang Road or Soldier Bazaar Road as alternative routes. The Karachi Traffic Police have imposed strict restrictions on heavy vehicles for the duration of the procession. Heavy traffic will not be allowed to enter the city from 10:00 a.m. until the conclusion of the Chehlum procession. The restriction is aimed at preventing congestion and ensuring the safety of participants and the general public. Transport operators have been instructed to adjust their schedules accordingly and avoid entering restricted areas during the specified hours. Authorities have also announced a complete ban on parking along the procession route. Any vehicle found parked in prohibited areas will be immediately towed away without prior notice. Traffic police have warned motorists to comply with parking regulations and follow the instructions of officers on duty to avoid penalties and unnecessary inconvenience. The central Chehlum procession is scheduled to begin at 9:00 a.m. on Tuesday, August 4, from Nishtar Park. A large number of mourners are expected to participate in the religious gathering, prompting extensive security and traffic arrangements across the city. Police and traffic officials will remain deployed throughout the procession to manage vehicle movement, assist commuters, and maintain public order. Committee members expressed deep concern that this leadership vacuum is undermining investor confidence and delaying strategic initiatives crucial for industrial growth. Mandviwalla warned that the prolonged absence of leadership threatens compliance with Pakistan’s commitments under the IMF Extended Fund Facility (EFF), particularly the phase-out of incentives and restrictions on EPZ sales to the domestic market. Industry representatives attending the committee highlighted growing discontent over the draft Auto Policy 2026–31. While the policy aims to boost New Energy Vehicles (NEVs), increase domestic value addition, and expand exports, local manufacturers face crippling challenges. High tariffs on raw materials, steep duties, and overall cost disadvantages were flagged as severe obstacles that could prevent the policy’s objectives from materializing. “The government’s plan is ambitious, but without resolving operational bottlenecks, domestic producers will be left behind while international competitors gain an advantage,” said a senior industry official. The committee directed all stakeholders to submit formal grievances and scheduled a follow-up joint session with the Ministry of Commerce and the Ministry of Industries and Production to ensure these issues are addressed before the next IMF review. Officials confirmed that EPZ incentives and operational rules require immediate reform, warning that failure to act decisively could deter foreign and domestic investment, compromise manufacturing growth, and slow Pakistan’s economic recovery.       A petition submitted to the Islamabad High Court (IHC) has challenged President Asif Ali Zardari’s delay in approving the appointment of judges to several high courts across Pakistan. The petitioner argues that the president’s failure to act on the recommendations has created a serious constitutional issue and worsened the shortage of judges, affecting the country’s justice system. The petition was filed by Advocate Luqman Zafar Chaudhry through his legal counsel, Zahid Asif Chaudhry. It requests the court to issue a writ of mandamus directing the president, through his secretary, to immediately approve the summary sent by the prime minister. The summary contains the recommendations of the Judicial Commission of Pakistan (JCP) for appointments to the Islamabad, Lahore, Sindh, and Balochistan High Courts, along with the confirmation of several additional judges. According to the petition, the Judicial Commission, chaired by the Chief Justice of Pakistan, completed the constitutional process by finalizing its recommendations on July 20 and 21. These recommendations were subsequently forwarded to the president under Article 48 of the Constitution through the prime minister. However, the president has neither approved the summary nor returned it for reconsideration, despite the constitutional process requiring timely action. The petitioner maintains that Article 48 allows the president to return the prime minister’s advice only once within 15 days for reconsideration. Beyond that, the Constitution does not permit indefinite delay or silence. Therefore, the petition argues that the president is constitutionally obligated to approve the recommendations once the prescribed period has passed. It further states that the delay disrupted the oath-taking ceremony for the recommended judges, which had been scheduled for July 27. As a result, the ceremony was postponed indefinitely, leaving several judicial positions vacant and increasing the burden on existing judges. The petition also argues that the president’s inaction effectively transforms a ceremonial constitutional responsibility into an unauthorized veto power, something the Constitution does not allow. It claims this undermines judicial independence protected under Articles 2A and 175(3) of the Constitution. Referring to previous Supreme Court judgments, the petitioner emphasizes that judicial appointments must be completed through a transparent, collaborative, and time-bound constitutional process without executive interference. The petition also compares the president’s role under Article 48 with Article 75, which governs presidential assent to legislation and similarly requires action within a specified timeframe. According to the petitioner, the continued delay has created an acute shortage of judges, slowing the disposal of cases and affecting citizens’ constitutional rights to a fair trial and access to justice under Articles 9, 10A, and 25. The petition also raises concerns that the delay may have been influenced by political considerations rather than constitutional requirements. Citing media reports and public statements, it requests the court to determine when the Presidency received the summary, seek an explanation for the delay, declare the continued inaction unlawful, and prevent any action inconsistent with the Judicial Commission’s recommendations until the case is decided. The controversy has emerged amid a wider constitutional debate regarding the president’s authority in judicial appointments. While earlier Supreme Court decisions have held that the president cannot reject recommendations made by the Judicial Commission, Article 175A(8) does not clearly specify how quickly the president must act. Legal experts believe the issue may ultimately require judicial interpretation to clarify the constitutional limits of the president’s role in the appointment process.

    Jeana Keough unable to speak as cancer treatment takes heavy toll

    Former The Real Housewives of Orange County star Jeana Keough is facing another difficult setback in her battle with tongue cancer, with her family revealing that the 70-year-old is now unable to speak as treatment continues to take a severe physical toll. The update comes just days after Keough’s family announced that she had been diagnosed with squamous cell carcinoma of the tongue. She added, “Poor mama has to spit into tissues all day.” According to Kara, Jeana has already undergone two surgeries after doctors discovered that the cancer had spread to her lymph nodes. Alongside surgery, she has been receiving chemotherapy, radiation therapy and immunotherapy in an effort to treat the disease. However, the aggressive treatment has left the former reality television personality physically exhausted and struggling with everyday activities. Kara revealed that her mother has become “exhausted, struggling to stay awake, and becoming malnourished because the pain in her tongue and throat makes swallowing even the smallest bites or sips incredibly difficult.” The family had hoped to improve Jeana’s nutrition by having a feeding tube (G-tube) inserted after she reportedly went two weeks without eating a proper meal. Those plans, however, have now been postponed after doctors identified additional health complications. According to Kara, physicians discovered both a deep vein thrombosis and an infection in her leg, forcing them to delay the procedure. Explaining the situation, Kara wrote, “The feeding tube can’t be put directly into her stomach until there’s clarity on the infection.” As a result, Jeana’s cancer treatment has temporarily been placed on hold while doctors focus on treating the infection before proceeding with further care. Despite the difficult circumstances, Kara remained hopeful and asked supporters to continue keeping her mother in their thoughts and prayers. She shared the family’s current prayer requests, writing, “Prayer needs: that this infection clears quickly, that she can get the G-tube surgery imminently so that hangry Jeana doesn’t murder someone, and that we can quickly resume treatment so that this torment can be put in the rear view mirror.” The message combined honesty with humour, reflecting the family’s determination to stay optimistic during an extremely challenging period. Jeana first rose to fame as one of the original cast members of The Real Housewives of Orange County, where viewers followed her personal and family life over several seasons. Since news of her diagnosis became public, fans and fellow reality television personalities have flooded social media with messages of encouragement and support. For now, Jeana’s family remains focused on clearing the infection, improving her nutrition and ensuring she is strong enough to resume cancer treatment as soon as doctors determine it is safe to do so.
