The Federal Constitutional Court has issued an important ruling in favour of corporate taxpayers. The court has declared the adjustment of tax credits against super tax legally valid. It has also overturned an earlier decision of the Islamabad High Court. Justice Amir Farooq authored the six-page detailed judgment. The court accepted the appeals filed by a private mobile phone company. The case relates to the adjustment of tax credits against super tax. The company had challenged a demand raised by the Federal Board of Revenue (FBR). The FBR had issued a notice to the private company. The notice required the company to pay super tax. The company approached the Islamabad High Court after receiving the notice. It argued that its available tax credit should be allowed to adjust against the super tax liability. The Islamabad High Court rejected the company’s petition. The company then challenged that decision before the Federal Constitutional Court. The Federal Constitutional Court has now accepted the company’s appeals. It has declared that tax credits available to a taxpayer can be adjusted against super tax. The court referred to the relevant provisions of the tax law. It observed that the tax credit available under Section 168 is a separate and legally recognised right. According to the judgment, a taxpayer should not be prevented from using this credit for adjustment. The court said forcing a taxpayer to seek only a refund would not be consistent with the intention of the law. The judgment also addressed the interpretation of financial and tax laws. The court observed that such laws should be interpreted in a manner that facilitates taxpayers. The court emphasised that taxpayers should be able to exercise rights provided to them under the law. A legal right to a tax credit cannot be unnecessarily restricted through an interpretation that creates additional difficulties for taxpayers. The court also issued directions to the FBR. The FBR has been directed to examine the taxpayer’s claim for adjustment. The department must consider the claim in response to the tax notice. The FBR will now have to decide the matter according to the applicable law and the court’s ruling. The judgment provides an important clarification for corporate taxpayers. It establishes that an eligible tax credit can be considered for adjustment against a super tax liability. The ruling may also have wider implications for companies facing similar tax demands. Businesses with legally available tax credits may now rely on the court’s interpretation when seeking adjustments against their tax liabilities. By setting aside the Islamabad High Court’s decision, the Federal Constitutional Court has clarified the legal position on the issue. The case also highlights the continuing dispute between taxpayers and the FBR over the interpretation and application of tax laws.

The investigation into the death of 25-year-old businessman Mir Raza Ali has taken a new turn after police added a murder charge to the case and reconstituted the team handling the probe. Ali’s body was discovered in bushes in Karachi’s Gulistan-i-Jauhar on July 29, a day after he was reported missing. His family has maintained from the outset that he was abducted, subjected to torture and killed, while the initial police investigation had considered the possibility of suicide. The latest development came after a second post-mortem examination produced findings that differed from the initial medical report. According to an order issued by the Sindh Inspector General of Police’s office, the investigation team has been reorganised following the findings of the second autopsy. The first information report (FIR), initially registered under Section 365 of the Pakistan Penal Code for kidnapping, now also includes Sections 302 and 201. Section 302 deals with murder, while Section 201 relates to causing evidence of an offence to disappear or providing false information to protect an offender. A five-member team has now been assigned responsibility for the investigation. It is headed by Sindh Deputy Inspector General (Crime and Investigation) Amir Farooqui and includes senior police officers from different investigative units. The new team has been directed to conduct a thorough and impartial investigation and examine the case from every relevant angle. Police have also been instructed to identify, secure and analyse any new evidence, including physical, forensic, technical and circumstantial material. The team has been asked to make every effort to determine what happened to Ali and submit its findings to the relevant court within the required timeframe. Investigators will also provide daily updates on the progress of the case. The development follows demands from Ali’s family for a change in the investigation. Family lawyer Jibran Nasir had called for the original probe to be replaced after the businessman’s body was exhumed for a second post-mortem examination. According to the family’s legal representative, the fresh examination found evidence indicating that Ali had been shot in the back. He argued that the finding contradicted the earlier possibility of suicide and supported the family’s allegation that Ali had been murdered. Nasir has further alleged that Ali was tortured before his death, describing him as a young and ambitious businessman whose death had left his family seeking answers. The lawyer has also criticised the handling of the case by senior police officials, claiming that the family faced harassment and pressure instead of receiving a satisfactory investigation.

HARIPUR: Police have arrested four suspects in connection with the alleged abduction, sexual assault and murder of a five-year-old girl whose body was recovered from a deserted well in Haripur after an extensive search operation. Haripur District Police Officer Shafiullah Gandapur said the child was reported missing by her father on August 10. Police registered a case under relevant provisions of the Pakistan Penal Code and launched a search operation to trace her. A special investigation team was subsequently formed, comprising senior police officers, investigators and female police officials. A separate technical team was assigned to examine digital evidence, including CCTV footage, call records and geofencing data. Police reviewed footage from around 200 cameras and examined the records of 20 suspected telephone numbers. Investigators said footage from 12 cameras proved particularly significant in reconstructing the child’s movements after she left home and identifying individuals allegedly travelling in the area on foot and on a motorcycle. Three suspects were initially arrested, and police also recovered a motorcycle allegedly used in the incident. According to police, one suspect recorded a statement before a court admitting his involvement in the alleged abduction and sexual assault. The other suspects were produced before the court for further legal proceedings. Police later arrested a fourth suspect. Information obtained during the investigation led officers to a deep, dry and overgrown well located on a vacant plot near Link Road on University Road, close to a warehouse. A search team, assisted by Rescue 1122 personnel, recovered the child’s body from the well. The recovery operation was monitored by the DPO and senior members of the investigation team. The body was shifted to the Rescue 1122 Trauma Centre in Haripur, where a post-mortem examination was conducted. Doctors collected X-rays and samples for DNA and other forensic examinations. The results are awaited. The investigation has faced additional difficulties because some suspects are reportedly underage and did not possess identity documents. Police said they therefore examined telephone records linked to their family members and other numbers considered relevant to the case. The search for the missing child involved hundreds of personnel. More than 400 police officials, along with staff from the Tehsil Municipal Administration and Water and Sanitation Agency, participated in searches covering drains, sewerage lines, vegetation, vacant plots and deserted locations around the University of Haripur, Pathan Colony and nearby areas. Khyber-Pakhtunkhwa Inspector General of Police Zulfiqar Hameed took notice of the case, while Hazara DIG Nasir Mahmood Satti visited Haripur to review the investigation. The DPO briefed him on the evidence collected, CCTV findings and progress in identifying and arresting the suspects. The DIG also met the victim’s family and assured them that the investigation would be pursued according to law. Meanwhile, K-P Chief Minister Sohail Afridi condemned the alleged crime and ordered a comprehensive investigation. He directed authorities to ensure that every aspect of the case was examined and that those found responsible were dealt with strictly under the law. The chief minister expressed condolences to the child’s family and said crimes against children would not be tolerated. He assured the family that the provincial government would support them and that the suspects would face legal consequences if found guilty.
